Shandong Linyi City Procuratorate and Court Hand Down Seven and Nine-Year Sentences

(Minghui.org) The local police department, Procuratorate, and court in Linyi City, Shandong Province, have openly violated the law by secretly trying Ms. Deng Liangcun and sentencing her to seven years in prison. Ms. Fu Guiying was similarly sentenced to nine years in prison. Their attorneys from Beijing were astonished by these harsh sentences.

Linyi City Falun Gong practitioners Ms. Deng and Ms. Fu were arrested in Lanshan, Linyi City, on June 6, 2012, and taken to the Lanshan Domestic Security Team. They were later detained in the Linyi City Detention Center. Their arrest warrants however, were not issued until one month later, on July 6. During that time, their families did not receive any notification.

Ms. Deng and Ms. Fu's families hired two attorneys from Beijing in accordance with legal procedures. The two attorneys were very sympathetic with their suffering as a result of the persecution and prepared “not guilty” pleas.

Ms. Fu Guiying, 43, is a resident of Zhujiawa Village, Fangqian Township, Junan County, Linyi City. She was in good physical condition before the arrest. She now looks as if she is at least 60 years old. Her hair has turned grey, and she looks haggard and emaciated.

After beginning Falun Gong cultivation practice, Ms. Fu followed the principles of Truthfulness-Compassion-Forbearance as a guide in her life and enjoyed excellent health. She took good care of her husband and children, and their family was a happy one.

Ms. Deng Liangcun 53, is a resident of the Lanshan District, Linyi City. After she started practicing Falun Gong, her illnesses disappeared and she became healthy. She is kind and gentle.

Local Police Department and Lanshan District Court Violate the Law

The families of Ms. Fu and Ms. Deng hired two attorneys from Beijing, who braved the storm on September 7 to do paperwork at the Procuratorate and go to the detention center to visit their clients. The detention center denied their request to visit, claiming that the case was past due and visitation was no longer allowed. The Procuratorate staff then told them that the case had been returned to the Lanshan Domestic Security Division.

That afternoon, the family members went to the Domestic Security Division to inquire about the situation. Captain Liu Hongyi told them that the dossiers had been returned to the Procuratorate. The families went to the Procuratorate on September 10. The staff there told them, “The case is here and you need to hire a lawyer.” However, the lawyers had already completed the procedures and were still unable to see the defendants, and they thus left.

The two attorneys traveled from Beijing to the Linyi Detention Center again on September 20. They were told that they couldn't visit their clients because their cases were under “supplementary investigation.” The attorneys had to return home with no progress.

The families called the detention center many times on September 29 and 30. The detention center either refused to answer the calls or refused to say anything. When the families went to the Petition Office of Lanshan Court, the staff was very impatient and told them that they had not seen the case. The case had been submitted to the court on September 26 and the two practitioners received the indictment from the Lanshan Procuratorate on September 27. Neither their family members nor their attorneys were notified.

On the morning of October 8 (seven days after the national holidays), without informing the defense lawyers or the families, the Lanshan District Court tried Mr. Deng and Ms. Fu.

The two lawyers went to the Lanshan Procuratorate to ask prosecutor Gao Jianyun for the indictment on October 17, but Gao refused to provide it. When the lawyers asked him why the court failed to inform the lawyers, Gao said he had no contact information. The lawyers told him that the contact information was on the power of attorney. Gao opened the file and saw the contact information in the document, but he immediately closed it and said, “I am under no obligation to inform you.” He then actually pushed the lawyer, saying, “Leave now. You can sue me. Sue me anywhere you like.”

During this whole process, the Lanshan Procuratorate, Domestic Security Division, Linyi Detention Center, and the court kept passing the buck to prevent the attorneys from visiting the practitioners. They had no regard for the law. Their staff were rude and unreasonable. They deceived the lawyers and family members and violated the law.

610 Office of the Political and Legal Committee the Driving Force Behind the Persecution of Falun Gong

The local police department, Procuratorate, and court in the Lanshan District and Linyi City have ignored the law. They repeatedly lied to deceive the families and the lawyers and denied the attorneys their legitimate rights. In fact, they all know that the persecution of Falun Gong is illegal. They are ashamed to let the public see what they are capable of, but what they have done reveals that they have been deceiving only themselves.

Why does the Chinese Communist Party (CCP) at all levels blatantly show contempt for the law? What is the driving force behind it? What is the CCP afraid of?

The 13-year-long persecution of Falun Gong has been a violation of justice. At heart, the CCP minions are apprehensive and cowardly, fearful, in this case, that two lawyers were going to plead “not guilty” on behalf of their clients. It is an irrefutable fact that the practice of Falun Gong is legal, and clarifying the truth is also legal. No Chinese law identifies Falun Gong as a “cult.” It is the CCP organizations and individuals involved in the persecution of Falun Gong that have been in violation of the law.

The Political and Legal Committee of the CCP is, in fact, in control of all of the illegal operations behind the scenes. It is the infamous 610 Office, which was established on June 10, 1999, that carries out the bidding of the CCP Political and Legal Committee. It doesn't even have a nameplate, playing a name-changing shell game: "Comprehensive Management Office" this month, "Maintaining Stability Office" the next, and so on. It is reminiscent of the Central Cultural Revolution Group during the Cultural Revolution and the Gestapo during World War II.

The 610 Office, with sub-offices spread throughout all levels within the CCP, openly override the police departments, Procuratorates, and courts. It is a totally illegal entity. It has no authority to order any organization to imprison or detain citizens, and the tactics it uses to persecute Falun Gong are completely criminal. All too many individuals are collaborating with its crimes. The laws will cut off their escape routes in the future.

The “World Organization to Investigate the Persecution of Falun Gong” was established on January 20, 2003. Its goal is to investigate groups and individuals involved in the persecution. So are, 7,051 responsible parties and 13,332 individuals have been reported.

On September 30 of that year, a similar international group also established the “Global Public Trial of Jiang Zemin.” Nearly 60 lawsuits in over 30 countries have been filed against Jiang Zemin and 35 of his cronies for genocide, crimes against humanity, and crimes of torture. The lawsuits were based on the “International Criminal Court” and the “United Nations Committee against Torture.” There are 18 suits against Jiang Zemin alone. It is the largest international human rights litigation since World War II.

Convinced by the CCP lies, many people who did not know the truth participated in the persecution of Falun Gong and its practitioners and have committed unforgivable crimes. Thousands of Falun Gong practitioners have been persecuted to death. Owing to the changing situation and the perseverance of practitioners clarifying the truth, many people have come to their senses and recognized the evil nature of the CCP and made the wise choice to quit the Party and its affiliated organizations. History will see CCP officials at all levels tried and brought to justice.

We sincerely advise those who have betrayed their conscience for personal gain to stop working for the CCP, do so immediately, and start a new life. Otherwise, they will be brought to trial.
