(Minghui.org) On December 27, 2013, the attorney for Mr. Hao Xiangtang learned that his client's case had been rejected and kicked back to local authorities due to insufficient evidence.
At an in-person meeting, the Qiaodong District Procuratorate in Xingtai City, Hebei Province informed the attorney that Mr. Hao's case was returned and should be with the Domestic Security Division of the Gaokai District Police Department in Xingtai City. The exact date the case was returned was unknown.
The attorney then visited the domestic security division and tried to confirm the rule that Mr. Hao's case should be processed for release within a month after his arrival. Wang Huanfang, the instructor at the division, said without much explanation, “It may be delayed.”
Illegally Detained for 38 Days
Mr. Hao Xiangtang, 48, from Shahe City, Hebei Province, was a former technologist in the Shahe Textile Factory. He was arrested on July 14, 2013, on a bus from Xingtai to Shahe.
Mr. Hao was first detained at the Gaokai District Police Department in Xingtai City, then transferred and detained at other facilities:
The Gaokai District Police Department in Xingtai City: one day The Shahe Team of the Hebei Province Criminal Offense Squadron: 25 days The Dongwang Police Station: 12 days
Officers at the above facilities not only violated the Constitution, but also China's “Police Law” and “Criminal Law.”
Article 14 of the “Police Law” stipulates: “A suspect may not be held in a police department for more than 24 hours. This time can be increased to 48 hours in exceptional circumstances. But approval by authorities from the county police department or higher authorities is required. Immediate notification of the family is also required for any extended detention.”
Mr. Hao was detained for a total of 38 days; his family was never notified. When the family asked for information about him, director of the domestic security division Liu Dongbo and instructor Wang Huanfang tried to arrest them.
Tortured for “Evidence”
Without knowing that Mr. Hao's case had already been returned, the attorney visited him at the No. 1 Detention Center in Xingtai City to collect facts about the persecution he endured. The attorney learned that Liu Dongbo, director of the domestic security division, had interrogated Mr. Hao with torture, trying to force Mr. Hao to agree on their charges.
On the first day of Mr. Hao's arrest, Liu Dongbo with the Domestic Security Division; Li Jiannong, deputy director' and officers from the Gaokai District Department beat the soles of Mr. Hao's feet with tree branches. He was shocked with electric batons the next day. He was interrogated in an effort to find out where he lived, who his contacts were, and who supported him.
Captain Hao Qingbo and instructor Tan Zhende transferred Mr. Hao to the Shahe Team of the Hebei Province Criminal Offense Squadron. He was cuffed to an iron chair and interrogated around the clock for 25 days.
He was later transferred to the Dongwang Police Station and deprived of sleep. He was detained there for 12 days.
The Domestic Security Division of the Gaokai District Police Department in Xingtai City didn't process Mr. Hao's release after getting the returned case from the Procuratorate. Instead, they tortured him to try to force him to agree to their fabricated evidence to further “qualify” the case.
