Shanghai Court Bypasses Legal Process, Upholds Ms. Zhu Yumei's Unjust Conviction

(Minghui.org) When Ms. Zhu Yumei's attorney and family visited her at the Changning Detention Center on February 28, 2014, they learned that the Shanghai No. 1 Intermediate People's Court had upheld Ms. Zhu's unjust conviction. They had sent notification of their decision to the detention center on February 24. There had been no trial or open process. The attorney and family did not receive any written information, and the original decision was upheld in a complete black-box operation.

Officers from the Changning District 610 Office, the local domestic security division and the Beixinjing Police Station in Shanghai expended a lot of manpower to arrest six Falun Gong practitioners across various provinces and regions, on the night of October 31, 2012 until early the next morning.

Those practitioners were Mr. Ye Jianhua, his wife Ms. Zhu Yumei and their five-year-old daughter; Mr. Zhao Xianliu from Songjiang District; Ms. Li Jing and her eight-year-old son from Pudong; Ms. Lan Lizhi from Pudong; and Mr. Bao Decong from the Hongkou District. Apart from Ms. Zhu Yumei, who was held at Changning Detention Center, the other five practitioners were all released on November 29, 2012.

The Pudongxin District Court put Ms. Zhu on trial on September 26, 2013 and sentenced her to three and a half years in prison. The Pudongxin District Procuratorate was in charge of prosecuting Ms. Zhu. Procurators Pang Zheng and Pan Li, Chief Judge Xiao Bo, and Judges Wang Meiling and Shi Yaohui were also present.

The prosecution charged Ms. Zhu with the offense of Article 300 of the criminal law, which is “using cult organizations to sabotage law enforcement.” Ms. Zhu's attorney asked the prosecutors to show which clause or article of the law states that Falun Gong is a cult and which law Ms. Zhu had sabotaged. Chief Judge Xiao Bo also asked the prosecutors to show such evidence. Since there is no legal basis for such a charge, they were unable to respond.

Because the 610 Office pulls the strings in such cases, the court ultimately supported the prosecutors and sentenced Ms. Zhu to prison. Their legal basis was still Article 300 of the criminal law and a “judicial interpretation” on the part of the Supreme Court and the Supreme Procuratorate. The defense arguments of both Ms. Zhu Yumei and her attorney were ignored.

Ms. Zhu did not accept the verdict and appealed to the Shanghai No. 1 Intermediate Court. Judge Chen Guangfeng from the intermediate court went to the detention center and met with Ms. Zhu in person. But now, Judge Chen had upheld the original decision with the excuse that “Defense Attorney Wang has taken too long, the court could not wait forever.” The court, in handling such an important matter of a citizen's innocence, did not listen to the views of anyone on the defense side, nor did they give any explanation for their reasoning regarding the appeal. They also did not issue a formal written notice before the verdict, all of which indicates that the CCP judges disregard human life.

Ms. Zhu has been held at the Changning Detention Center in Shanghai for one year and four months, where she could face evil persecution at anytime. The police did not allow her to shower for nearly 20 days during the hot summer when it was over 40 degrees Celsius.

Up to now, Ms. Zhu family has not received any written verdict. The defense attorney Wang sued Judge Chen Guangfeng of the Shanghai Procuratorate, exposing their illegal acts.
