Hubei Man Sues Judge for Wrongful Conviction

(Minghui.org) A Wuhan City resident was sentenced to 1 year and 9 months on August 1, 2017 for spreading information about Falun Gong (also known as Falun Dafa), a spiritual discipline being persecuted by the Chinese communist regime. Mr. Fu Shengqiang is suing the presiding judge for wrongful conviction.

Mr. Fu was arrested on October 6, 2016 after being reported for writing “Falun Dafa is good” on a utility pole. He was taken to Bali Detention Center, where he remains today.

Police gave Mr. Fu an administrative detention, and the local procuratorate soon issued a formal arrest warrant against him. An indictment followed shortly afterwards.

During the trial on June 23, 2017, Mr. Fu’s lawyer argued that no law in China criminalizes Falun Gong or labels it a cult and that his client had every right to spread information about Falun Gong. The lawyer also pointed out that it was illegal for the police to give his client an administrative detention while pursuing criminal charges against him.

Mr. Fu also testified in his own defense and requested an acquittal. Presiding judge Wang Zhiwu sentenced him to prison on August 1.

Mr. Fu is appealing his case with Wuhan City Intermediate Court. He has also filed a complaint against judge Wang and his subordinates Liu Huogou and Xu Qingfa for convicting him without any legal basis.
