Police Fabricate Evidence Against Falun Gong Practitioner

(Minghui.org) When Mr. Zheng Xufei's lawyer was reviewing his case documents on August 15, 2017, he noticed that one document had only a signature and was lacking Mr. Zheng's fingerprint, whereas all the other documents had been fingerprinted.

The document said, “Zheng Xufei was arrested on August 13, 2015. He was detained for ten days and paid a 1000-yuan fine.”

Questioning the authenticity of the document, the lawyer called Mr. Zheng's family and learned that the August 13 arrest had never taken place.

When the lawyer visited Mr. Zheng in the detention center the next day, Mr. Zheng confirmed that he had never been arrested or detained in 2015. He also said he didn't sign the document in question.

Mr. Zheng told the lawyer that the 1000-yuan fine was related to his arrest on July 11, 2014. He had been detained for 35 days and his family had paid the police 5000 yuan as bail. The police called him almost a year later, on August 13, 2015 (the date of the alleged arrest), and told him that they would return the 5000-yuan bail money but that he would have to pay a 1000-yuan fine and deposit the money in a specific bank account.

Having discovered the forged signature and falsified document, Mr. Zheng wrote to the Procuratorate, demanding an investigation. Mr. Zheng's family also testified in writing that he wasn't arrested or detained on August 13, 2015.

The lawyer submitted the request to the procuratorate soon after his meeting with Mr. Zheng but has yet to receive a response.

On August 24, 2017, Mr. Zheng's mother, who is nearly 70, and his 89-year-old grandmother went to the procuratorate and filed another complaint against the police for fabricating the document. The person on duty accepted their complaint and told them that the issue was still under investigation. He then refused to issue them a receipt verifying that they had filed the complaint, saying, “I'm not giving you a receipt. It's good enough if I keep it.”

When Mr. Zheng's mother asked to meet with the prosecutor in charge of the case, she was told that Gong Xiaoling, the prosecutor, wasn't in the office. When they tried to reach her by phone, it always went unanswered.

While Mr. Zheng's family was working to free him, the police seemed convinced that he would be sentenced to prison this time. One officer told Mr. Zheng's family a few days after his case was submitted to the procuratorate, “You have no hope of rescuing him.”

Mr. Zheng's family became suspicious about the role of the police in his case. By law, the police are only in charge of investigating, not determining the outcome of a case. It seemed to the family that everything had been planned in advance and that Mr. Zheng’s sentence might have already been determined.

Mr. Zheng was arrested on July 14, 2017, while passing out information about the communist regime’s persecution of Falun Gong. Someone he spoke to accepted his materials and reached into Mr. Zheng's pocket and asked if he had more. Mr. Zheng told him that he was running out.

Concerned that the person might be a plainclothes officer, Mr. Zheng immediately headed home. But before he could get there, three people arrested him. They took him to the police station and then to the detention center.

The Procuratorate approved his arrest about ten days later. In less than a month, the police submitted his case to the procuratorate on August 11, 2017.

Mr. Zheng Xufei, 42, is a physical education teacher at Xiachu Town Elementary School in Rushan City, Shandong Province. He started to practice Falun Gong in 2011. For telling people about the persecution of the spiritual discipline, he was arrested in 2014 and detained for 35 days. His salary was reduced, and his merit pay has been withheld since 2015.
