Liaoning Woman Jailed for Suing Former Chinese Dictator

(Minghui.org) A Huludao City resident was sentenced to one year in prison for filing a criminal complaint against former Chinese dictator Jiang Zemin for initiating the persecution of Falun Gong, a spiritual discipline based on the principles of Truthfulness-Compassion-Forbearance.

Ms. Yang Lichun was arrested on June 15, 2017, and appeared in the Longgang District Court on November 30, 2017. Only her daughter was allowed to attend the trial. The rest of the seats in the courtroom were taken by police and agents from the local 610 Office and Political and Legal Affairs Committee, both extra-judicial agencies tasked with eradicating Falun Gong.

The main evidence for the prosecution was Ms. Yang’s complaint against Jiang filed with Supreme People’s Court and Supreme People’s Procuratorate. Her daughter argued that the two highest judicial organizations should have kept private citizens’ complaints confidential and that they violated the law by forwarding Ms. Yang’s complaint to the local police.

The daughter also argued that the Constitution guarantees every citizen’s right to report on individuals or organizations whom he or she deems to have broken the law. As such, her mother had every right to report on Jiang for initiating the persecution of Falun Gong without any legal basis.

Judge Gu Yue ignored the daughter’s pre-trial request to invalidate the prosecution evidence. He also kept interrupting her as she testified in her mother’s defense and even threatened to toss her out of the courtroom if she didn’t stop.

Towards the end of the hearing, Gu said to Ms. Yang’s daughter, “Do you want to see your mother suffer in prison? Tell her to write a statement promising to renounce Falun Gong and I’ll release her.”

The daughter reiterated that her mother had broken no law by trying to seek justice against Jiang. She also refused to sign the court proceedings.

Ms. Yang was convicted on December 15, and her daughter was told that she had decided to not appeal the sentence. The younger woman didn’t believe that her mother would forgo the right to appeal and asked to see her in the detention center.

The daughter was denied visits, so she filed an appeal on her mother’s behalf with the Huludao City Intermediate Court on December 25.

Background

In 1999, Jiang Zemin, as head of the CCP, overrode other members of the Politburo Standing Committee and launched the violent suppression of Falun Gong.

The persecution has led to the deaths of many Falun Gong practitioners over the past 18 years. More have been tortured for their belief and even killed for their organs. Jiang Zemin is directly responsible for the inception and continuation of the brutal persecution.

Under his personal direction, the Communist regime established an extralegal security organization, the 610 Office, on June 10, 1999. This organization overrides police forces and the judicial system in carrying out Jiang's directive regarding Falun Gong: to ruin their reputations, cut off their financial resources, and destroy them physically.

Chinese law allows its citizens to be plaintiffs in criminal cases, and many practitioners are now exercising that right to file criminal complaints against the former dictator.
